Connecticut Prenuptial Agreement Template
This Connecticut Prenuptial Agreement (hereafter "Agreement") is entered into and made effective as of __________ (the "Effective Date"), by and between __________ (the "First Party") and __________ (the "Second Party"). The First Party and Second Party shall collectively be known as the "Parties" and individually as a "Party" in this Agreement.
WHEREAS, the Parties intend to marry under the laws of the state of Connecticut, and in contemplation thereof, they wish to define and govern their rights and obligations concerning their current and future property, both separately and together, among other matters; and
WHEREAS, this Agreement is established in accordance with the Connecticut Premarital Agreement Act (Connecticut General Statutes, Sections 46b-36a to 46b-36j) and aims to ensure fairness and clarity in the management of the Parties' financial matters.
NOW, THEREFORE, in consideration of the impending marriage, and the mutual promises and agreements contained herein, the Parties agree as follows:
- Disclosure of Assets and Liabilities. Each Party has fully and fairly disclosed to the other Party their respective assets and liabilities. Attachments A and B hereto list the respective assets and liabilities of the First Party and the Second Party as of the date of this Agreement.
- Property Rights.
(a) Separate Property - All property currently held by each Party shall remain the separate property of that Party unless both Parties agree in writing to change the nature of the property.
(b) Marital Property - Any property acquired by either Party during the marriage ('Marital Property') shall be subject to division as outlined in this Agreement or as otherwise agreed by the Parties in writing.
- Alimony and Support. The rights and obligations of each Party regarding alimony, maintenance, or support before, during, and after the dissolution of marriage shall be as set forth herein, or as the Parties may otherwise agree in writing.
- Amendment and Revocation. This Agreement can only be amended or revoked by a written document signed by both Parties.
- Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of laws principles.
- Entire Agreement. This Agreement constitutes the entire agreement between the Parties pertaining to its subject matter and supersedes all prior agreements, representations, and understandings of the Parties, written or oral.
